- Residential grading and yard leveling.
- Artificial turf installation.
- Pavers and outdoor living improvements.
- Irrigation installation and related services.
- Decorative gravel and rock delivery.
- Commercial landscaping and property improvements.
The availability, scope, and scheduling of services depend on project requirements, location, materials, site conditions, and business availability.
3. Estimates and Project Proposals
Estimates and proposals are based on the information available at the time they are prepared, including the requested work, property conditions, measurements, materials, and anticipated labor.
Unless otherwise stated in writing, estimates are preliminary and are not a guarantee of final project cost. Additional work, unforeseen site conditions, material changes, or customer-requested modifications may affect the final price.
Project pricing, included services, materials, exclusions, payment requirements, and estimated timelines should be confirmed in the written proposal or project agreement.
A project is not scheduled or authorized to begin until the required approval and any applicable deposit or payment arrangements have been completed.
4. Project Changes and Additional Work
Changes to the original project scope may affect the project price, materials, and completion date.
Additional work or changes requested by the customer should be reviewed and approved before the additional work begins.
Where appropriate, changes will be documented through a written change order, revised estimate, or other written approval identifying the additional work and any associated costs.
5. Payments and Deposits
Payment amounts, deposit requirements, payment milestones, and final payment terms will be established in the applicable estimate, invoice, or written project agreement.
Customers agree to make payments according to the payment schedule provided for their project.
Any applicable taxes, material charges, delivery fees, or additional approved work will be identified in the project documentation or invoice.
Late payments or failure to meet agreed payment obligations may affect project scheduling or continuation of services, subject to the applicable agreement and law.
6. Scheduling, Weather, and Delays
Project schedules and estimated completion dates are provided in good faith but may change due to circumstances outside our reasonable control.
Examples include:
- Severe weather, excessive heat, or unsafe working conditions.
- Material availability or delivery delays.
- Unexpected property or site conditions.
- Equipment availability or scheduling conflicts.
- Permit, inspection, or utility-related delays.
- Other circumstances beyond our reasonable control.
We will make reasonable efforts to communicate significant scheduling changes and coordinate revised project timelines.
7. Customer Responsibilities
Customers are responsible for providing reasonable access to the property and work areas during scheduled project activities.
Customers should:
- Provide accurate project and property information.
- Identify known underground utilities, irrigation lines, and other hidden features.
- Disclose known access restrictions and relevant property conditions.
- Secure pets and keep children and unauthorized individuals away from active work areas.
- Remove personal belongings, vehicles, and other obstacles from designated work areas.
- Obtain any property-owner or association approvals that are the customer's responsibility.
Responsibility for utility locating, permits, approvals, and site preparation should be established in the project agreement and applicable law.
8. Materials, Products, and Site Conditions
Landscaping projects may involve natural materials, manufactured products, plants, soil, gravel, pavers, artificial turf, irrigation components, and other construction materials.
Natural materials may vary in color, size, texture, shape, and appearance. Product samples and photographs are intended as general references and may not represent the exact materials delivered or installed.
Existing site conditions, drainage, soil composition, slopes, underground obstructions, and other conditions may affect installation methods and project results.
Material selections, specifications, and any applicable substitutions should be confirmed in the project agreement.
9. Cancellations and Project Termination
Customers who need to cancel or reschedule a project should contact Frank & Son Landscaping as soon as possible.
Cancellation terms, deposit treatment, charges for completed work, special-order materials, and other financial obligations will be governed by the applicable written project agreement and applicable law.
Nothing in these website terms is intended to waive any cancellation or other rights provided by applicable law.
10. Workmanship and Warranties
Any workmanship warranties, manufacturer warranties, product warranties, or maintenance requirements will be identified in the applicable project agreement or warranty documentation.
Warranty coverage, where provided, may depend on proper use, maintenance, environmental conditions, and compliance with applicable care instructions.
No specific warranty period or coverage is created by this website unless expressly provided in a separate written agreement.
11. Limitation of Liability
To the extent permitted by applicable law, Frank & Son Landscaping is not responsible for indirect, incidental, or consequential damages arising from the use of this website or circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited, including liability arising from negligence where such limitation is prohibited by law.
Any project-specific allocation of responsibility, warranties, or remedies will be governed by the applicable written project agreement and applicable law.
